1. Welcome to HER Balance Rx

1.1. Welcome to HER Balance Rx ("HER Balance", "HB", "we", "us", or "our"), owned by HER Balance LLC. These Terms and Conditions govern your ("you", "User", or "your") use of the HER Balance Rx mobile application and its related services.

1.2. HER Balance provides access to digital wellness tools including symptom tracking, hormonal phase monitoring, lifestyle recommendations, and a curated wellness knowledge base ("HER Balance Platform"). These tools are intended to support women's health through education, self-reflection, and wellness tracking—not medical care.

1.3. Our platform is available via our mobile app and, where applicable, via web-based access.

PLEASE NOTE: HER Balance Rx does not provide medical diagnoses or treatment. Always consult a qualified healthcare provider before making any health-related decisions. In an emergency, contact emergency services immediately.

1.4. You must be at least 13 years old to use the HER Balance Platform. If you are under 18, your use of the app requires consent from your parent or legal guardian.

1.5. If you do not agree to these Terms, you may not use the HER Balance Platform.

2. Legal Relationship

2.1. These Terms and our Privacy Policy together form the agreement between you and HER Balance Rx.

2.2. You may only create a user account if you accept these Terms. By using the app, you agree to be bound by them.

3. Privacy and Data Use

3.1. We take your privacy seriously. Please refer to our Privacy Policy for details on how your personal data is collected, used, and protected under laws such as the GDPR and CCPA.

3.2. You grant us a perpetual, worldwide, sublicensable right to use anonymized data derived from your use of the app to improve our services and for research and analytics purposes.

4. What HER Balance Does and Does Not Do

4.1. HER Balance provides personalized wellness content and lifestyle tracking tools based on user input. These may include tips, self-assessment summaries, wellness scores, and suggestions aligned with holistic wellness models (e.g., R.E.S.T: Reset, Eat, Stress, Train).

4.2. HER Balance is not a diagnostic tool. It does not provide clinical advice, prescribe treatments, or replace professional healthcare consultation.

5. User Account

5.1. Creating an account may be required to access certain features. You must use accurate, current information.

5.2. You are responsible for keeping your password and login credentials secure. If you suspect unauthorized use of your account, contact us immediately at hello@herbalance.app.

6. Usage Rights

6.1. HER Balance Rx grants you a personal, non-exclusive, non-transferable, revocable license to use the app for personal wellness tracking.

6.2. You agree not to:

• Repurpose or distribute any part of the app without permission.

• Attempt to reverse-engineer or access the source code.

• Use the app on behalf of another person without their consent.

• Upload harmful or offensive content.

6.3. Feedback you provide may be used by HER Balance to improve our services. You grant us a non-exclusive, royalty-free license to use such feedback.

7. Prohibited Conduct

You agree not to:

• Circumvent app security or copy content without permission.

• Create multiple accounts to misuse services.

• Use the app for unlawful purposes or to harm others.

• Upload malware or disrupt the app environment.

Violation of these terms may result in account suspension or legal action.

8. Termination

8.1. You may stop using HER Balance and request account deletion at any time.

8.2. We may suspend or terminate your access if you breach these Terms or misuse the platform.

9. Limitations and Disclaimers

9.1. HER Balance Rx makes no medical claims. The content is for informational purposes only.

9.2. We do not guarantee that the app will be error-free or available at all times.

9.3. TO THE MAXIMUM EXTENT PERMITTED BY LAW, HER Balance Rx disclaims all warranties and is not liable for any direct, indirect, incidental, or consequential damages arising from your use of the app.

12.1. These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict of law rules.

12.2. Any legal disputes must be resolved in a court located in Georgia.
